Terms of Service

1. Acceptance and eligibility

You must be at least 18 years old and legally able to enter this agreement. By creating an account, accepting these Terms in the app, or using ChirpTrio, you agree to these Terms, our Privacy Policy, and our Acceptable Use Policy. If you do not agree, do not use the service.

2. Accounts

You must provide accurate information, keep your login credentials secure, and promptly contact support@chirptrio.com if you suspect unauthorized access. You are responsible for activity through your account. Usernames, display names, and photos are user-provided and are not identity verification by ChirpTrio.

3. Current service

ChirpTrio currently provides app-to-app messaging, photo sharing, notifications, and live PTT for eligible accounts. SMS, MMS, traditional calling, subscriptions, and assigned telephone numbers are not included unless we expressly activate them under additional terms. Features may vary by device, account, location, and availability.

4. Your content

You retain ownership of content you submit. You grant ChirpTrio a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, display, and process that content only as reasonably necessary to operate, secure, moderate, and improve the service, respond to reports, enforce these Terms, or comply with law. You represent that you have all rights and consents needed to share your content.

You understand that recipients may view, retain, copy, photograph, or otherwise capture content you send. Do not send content you are not prepared to share with the selected recipient.

5. Live PTT and emergency services

PTT audio is transmitted live only while the talk control is active. ChirpTrio does not record or store person-to-person PTT audio as message history. ChirpTrio is not a telephone carrier, dispatch service, or emergency service. Never rely on ChirpTrio to contact 911 or any emergency responder; use a supported telephone service.

6. Acceptable use

You may use ChirpTrio only for lawful, consensual communication and in compliance with our Acceptable Use Policy. You may not send spam, scams, threats, harassment, illegal or exploitative content, malware, or non-consensual intimate material; impersonate others; evade blocks or enforcement; scrape the service; automate abusive activity; or interfere with security or operation.

7. Safety and enforcement

We may review reports and related evidence; remove or restrict content or features; preserve evidence; suspend or terminate accounts; and notify authorities or reporting organizations when reasonably necessary to protect users, operate the service, enforce our policies, or comply with law. Urgent action may occur without advance notice. We do not undertake to monitor every communication and are not responsible for user conduct.

8. Ownership of the service

ChirpTrio LLC and its licensors own the app, brand, software, interfaces, and service materials, excluding user content. These Terms grant you a limited, personal, revocable, non-transferable right to use the service as provided. They do not grant rights to our trademarks, source code, or other intellectual property.

9. Service availability and changes

We may change, limit, suspend, or discontinue any feature or the service. Interruptions, delays, message-delivery failures, and PTT connection issues may occur. We do not promise that the service will always be available, compatible, error-free, or suitable for any critical use.

10. Disclaimers

To the fullest extent permitted by law, ChirpTrio is provided “as is” and “as available,” without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, or complete security. Some jurisdictions do not allow certain exclusions, so portions of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, ChirpTrio LLC and its operators, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, communications, profits, goodwill, or business opportunity arising from the service or user conduct. Nothing in these Terms limits liability that cannot legally be limited.

12. Suspension, deletion, and survival

You may permanently delete your account in the app. We may suspend or terminate access for policy violations, safety or security risk, legal requirements, prolonged inactivity, or discontinuation. Sections that by their nature should survive—including ownership, content licenses already exercised, safety records, disclaimers, liability limits, and enforcement rights—survive termination.

13. Changes and general terms

We may update these Terms. Material changes will be posted and, when appropriate, presented in the app for renewed acceptance. If any provision is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent.
